Terms & Conditions
These terms set out how original paintings, prints, postcards, commissions and online courses are sold through artinessa.com. By placing an order, commission or course enrolment you agree to them. I've kept them as clear and human as I can.
01 About us
This website, artinessa.com ("Art Inessa", "I", "me"), is the studio of Inessa Falina, a botanical artist based in London, United Kingdom. You can reach me any time at hello@artinessa.com.
02 Artworks & descriptions
Every original is hand-painted, so each is unique. I describe medium, paper, dimensions and year as accurately as possible. Colours may appear slightly different on screen depending on your device — this is normal and not a fault. Originals are sold unframed unless the listing states otherwise.
- Originals — one-of-a-kind works; once sold, they are no longer available.
- Prints — limited-edition giclée prints on fine art paper, signed by the artist.
- Postcards — printed cards supplied with an envelope.
03 Making a purchase & payment
Buying is simple: choose your work and click Buy now — you'll be taken to a secure checkout to pay by credit or debit card (or PayPal). You can also add several works to your basket and pay for each securely. If you'd prefer, write to me directly at hello@artinessa.com.
Please provide your full delivery address, including postcode, and ensure someone can receive and sign for the artwork when it arrives. I cannot be held responsible for items delayed or lost due to incorrect delivery details.
Payments are processed securely by Square (and PayPal). Your card details are encrypted and handled entirely by the payment provider — I never see or store your card information. Prices are in pounds sterling (£) and include applicable taxes where relevant. Your order is confirmed once payment has cleared in full.
I take great care with pricing, but occasionally an error may occur. If a work is listed at an obviously incorrect price, I reserve the right to cancel the order and refund you in full — I'll always contact you first to explain and, where possible, offer the correct price.
04 Commissions
Commissioned paintings are created especially for you, based on your photographs and brief.
- A non-refundable deposit of 50% of the total commission fee is required before work begins. The remaining balance is due upon completion and before delivery of the artwork.
- I will share progress and a final image for your approval before shipping.
- As commissions are personal and made to order, they are not eligible for return or refund once approved and completed, except where the work arrives damaged.
- Typical lead time is 6–12 weeks depending on size and complexity; I'll confirm timing before we begin.
05 Shipping
Works are packed with great care and sent by tracked post. Dispatch is usually within 5–10 working days of cleared payment (commissions by arrangement). Transit insurance is optional: if you'd like your work insured in transit, it can be added for an additional cost — just let me know before your work is shipped.
It is the buyer's responsibility to provide an accurate, current delivery address. If you need to change it, email me at hello@artinessa.com with your order number within 24 hours of ordering — once an order has shipped, the address cannot be changed. I cannot guarantee a refund or replacement if delivery fails because of an incorrect address.
For international orders, any customs duties or import taxes are the buyer's responsibility, and any delays caused by customs processing are beyond my control. Risk passes to you on delivery; please open and check your parcel promptly.
06 Returns & cancellations
I want you to love your artwork. If you are a consumer in the UK or EU, you may cancel an order for a ready-made work within 14 days of receiving it. Please email me first, then return the work unused and in its original condition and packaging, using a tracked carrier (insuring the return is recommended) — the return postage is your responsibility. The original shipping cost is non-refundable, and if the work is not returned in its original condition you may be liable for any loss in value.
Once I have received and checked the work, I will process your refund or, where available, an exchange. Refunds are issued to the original payment method, usually within 3–5 business days. To cancel an order before it has been dispatched, please contact me within 24 hours of purchase.
This does not apply to commissioned or personalised works, which are made to order. Your statutory rights are not affected.
07 Damaged or lost items
If your work arrives damaged, please email me within 48 hours with photographs of the item and packaging. I will arrange a repair, replacement or refund as appropriate. If a parcel is lost in transit, I will work with the carrier to resolve it.
08 Online courses & tuition
I am preparing an online painting course, Painting with Inessa. When it launches, the following will apply to course enrolments:
- Access is granted for your personal, non-commercial use. All course videos, materials and resources remain my intellectual property and may not be shared, copied, resold or redistributed.
- Course fees are non-refundable. Because you receive immediate access to digital materials on enrolment, payments for online courses cannot be refunded once purchased.
- Non-completion of a course does not waive payment; once enrolled, course fees remain payable.
- Where a course is delivered through a third-party platform, that platform's terms may also apply.
If a course includes a community space where you can share your work or comments, posting there gives me permission to feature your contribution — for example to showcase student work or promote the course — with credit where appropriate. You are responsible for ensuring you own or have permission to share anything you post. If you'd prefer your work or name not to be shared, simply let me know and I'll respect that.
Full course terms will be confirmed at launch.
09 Copyright
All artworks, images and text on this website remain the intellectual property of Inessa Falina. Buying a work gives you ownership of the physical piece, but not the copyright. Artworks may not be reproduced, copied or used commercially without my written permission. I retain the right to reproduce images of my work — including commissioned pieces — for portfolio, promotion and print purposes, unless we agree otherwise in writing.
10 Licence & site access
You are welcome to browse and use this website as a customer. You may not copy, reproduce, resell or commercially exploit any part of the site — including images, artwork, descriptions, layout or design — without my written permission, nor use automated tools (robots, scrapers) to extract its content. Any unauthorised use immediately ends your permission to use the site.
11 Website disclaimer
The information on this website is provided in good faith for general purposes. I keep it as accurate and up to date as I can, but make no warranties as to its completeness, accuracy or availability, and any reliance you place on it is at your own risk. This site may link to other websites; I am not responsible for their content, and you visit them at your own risk.
12 Privacy
Any details you share (name, email, address) are used only to process your order, commission or enquiry, and to reply to you. I will never sell or share your information. If you join a waitlist or the journal, you can unsubscribe at any time.
13 Agreement, eligibility & changes
Please read these terms before buying or using anything on this site, including online courses. By placing an order, commission or course enrolment — or by continuing to use the site — you agree to them. You confirm that you are at least 18 years old (or the age of majority where you live). I may update these terms from time to time; the current version is always shown here with the date above, and continued use means you accept any changes. If there's anything you don't agree with, please contact me at hello@artinessa.com.
14 Limitation of liability
I take great care over every work and your order, but to the extent permitted by law, my liability to you for any claim arising from a purchase is limited to the price you paid for the work concerned. I am not liable for indirect or consequential losses. Nothing in these terms limits your statutory consumer rights, or my liability for anything that cannot lawfully be excluded.
15 Governing law
These terms are governed by the laws of England and Wales. They do not affect your statutory consumer rights.
